This product enables end users (“You” or “Your”) who select this option to integrate their chosen external Artificial Intelligence (AI) tools, content and services (“Third Party AI”) through Vizrt’s MCP (Model Context Protocol) server (“Vizrt AI Assisted Features”). With respect to Your option to deploy your chosen Third-Party AI through Vizrt AI Assisted Features in any of Vizrt’s products or services (“Vizrt Products”), the following terms and conditions shall apply: 

Third Party AI Models and Systems

Third Party AI—including but not limited to code, scripts, templates, configurations, and suggestions—is produced or made available by third-party developers and providers (“Third Parties”) of AI models and systems and/or your organization, and are not developed, owned, procured or controlled by or on behalf of Vizrt, its suppliers, agents, or Vizrt-authorized distributors or resellers of Vizrt Products. Your use of any Third Party AI may be subject to terms and conditions required by the applicable Third Party. 

User Responsibility

With respect to your use of Third Party AI with Vizrt Products, including through Vizrt AI Assisted Features, you are solely responsible for the following undertakings, together with any other Third Party AI provider terms: 

  • Reviewing, understanding, and validating all Third Party AI before use. 

  • Testing the Third Party AI in non-production environments prior to deployment, to include: 

  • Backing up Third Party AI prior to integration with Vizrt Products; 

  • Ensuring Third Party AI (and your use thereof, with or without integration into Vizrt Products) complies with your organization's then-current policies and procedures related to AI, data-governance, IT, and security, and your organization’s coding standards; 

  • Verifying that Third Party AI is generated and used in compliance with the Third Party AI providers’/deployers’ legal terms, policies and acceptable use guidelines, including those with respect to the infringement upon third-party intellectual property rights and other propriety rights; and 

  • Ensuring that any use of Third Party AI, including your use together with Vizrt Products, complies with applicable laws, regulations, your contractual obligations, including but not limited to, the EU AI Act and laws related to data privacy and artificial intelligence governance.

Any consequences resulting from the use of Third Party AI with Vizrt Products.

Note: In particular, we strongly recommend that you consider the risks associated with providing your inputs to a free or open source generative AI model or system where your inputs may be used to train the AI model. 

No Endorsement or Warranty of Third Party AI

The availability of Vizrt AI Assisted Features does not constitute an endorsement, recommendation, or approval by Vizrt, its suppliers, agents, or Vizrt-authorized distributors or resellers of Vizrt Products, of any Third Party AI or the use of any specific AI provider, model, or service. Selection and use of Third Party AI is at your sole discretion and risk, and Vizrt disclaims any warranty with respect thereto. 

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER VIZRT NOR ANY OF ITS AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBCONTRACTORS, OR ANY VIZRT-AUTHORIZED DISTRIBUTORS OR RESELLERS (COLLECTIVELY, THE “VIZRT PARTIES”), SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER ARISING OUT OF OR RELATING TO THE USE, INTEGRATION, PERFORMANCE, OR NON‑PERFORMANCE OF ANY THIRD‑PARTY AI , SERVICES, OR COMPONENTS NOT PROVIDED BY VIZRT IN CONNECTION WITH ANY VIZRT PRODUCT OR SERVICE.

Antivirus Considerations

Vizrt advises customers to use an AV solution that allows for custom exclusions and granular performance tuning to prevent unnecessary interference with our products. If interference is encountered:

  • Real-Time Scanning: Keep it enabled, but exclude any performance-sensitive operations involving Vizrt-specific folders, files, and processes. For example:

    • C:\Program Files\[Product Name]

    • C:\ProgramData\[Product Name]

    • Any custom directory where [Product Name] stores data, and any specific process related to [Product Name].

  • Risk Acknowledgment: Excluding certain folders/processes may improve performance, but also create an attack vector.

  • Scan Scheduling: Run full system scans during off-peak hours.

  • False Positives: If behavior-based detection flags a false positive, mark that executable as a trusted application.
